Traffic Tickets FAQ

Will Hiring a Lawyer Keep Points Off My License and Insurance?

No lawyer can promise an outcome, and there are no guarantees. We review the ticket and work to reduce or dismiss the charge, for example to a lower-point or non-moving violation, which can keep points off your license and limit insurance increases. An approved defensive driving course can also offset some points.

For most drivers, points and insurance matter more than the fine. A lawyer cannot promise a particular outcome, but understanding how the system works shows where a lawyer can make a real difference.

No Guarantees, but a Careful Review

Every case turns on its facts, the court, and the prosecutor. What a lawyer brings is a close review of the ticket for dismissal grounds, a timely request for the officer’s supporting deposition, and negotiation for a reduced charge. A common target is a non-moving violation, such as a parking violation, which carries no points. Any reduction requires the prosecutor’s offer and the court’s approval.

Your own driving history matters too. A driver with a clean record often has more room to negotiate than one with recent convictions, and a lawyer can tell you early what result is realistic for a record like yours. That way you can decide whether to fight with clear expectations.

How New York Points Work

The Department of Motor Vehicles assigns points for moving violations under its regulations (15 NYCRR Part 131). Our traffic ticket page lists the points for common violations. Two rules matter most:

  • Points are counted from the day of the offense, not the day you are convicted. Delaying a case does not move a ticket out of the window.
  • Two windows: 6 or more points within 18 months triggers a Driver Responsibility Assessment (VTL § 503(4)), and 11 or more points within 24 months can lead to a suspension (VTL § 510(3)).

Points vs. Convictions: What Insurers See

Points and insurance are separate systems. Your point total is a DMV tool for suspensions and assessments. Insurers, on the other hand, rate on convictions, and convictions stay on your driving record longer than points count toward your total. That is why a reduction to a non-moving violation can matter more than the points themselves: it can keep a moving violation off the record your insurer reviews at renewal.

Defensive Driving (PIRP)

New York’s Point and Insurance Reduction Program (VTL Article 12-B; Insurance Law § 2336) offers approved defensive driving courses, in person or online. Completing a course can:

  • Reduce your point total by up to 4 points for suspension purposes
  • Give you a 10 percent reduction in the base rate of your liability and collision premiums for three years

You can use a course to reduce points once every 18 months. It does not erase the conviction from your record, so it works best alongside a good result in court rather than as a replacement for one.
