Traffic Tickets FAQ

Do I Need to Appear in Albany Court If I Hire a Lawyer?

In many cases, you may not need to appear. Where the court allows, we handle court appearances for you in Albany City Court and the surrounding town and village courts. The judge can still require you to attend, and misdemeanors such as DWI or aggravated unlicensed operation generally require you in person.

Taking a morning off work to sit in traffic court is one of the main reasons drivers hire a lawyer. For many traffic tickets in Albany and the surrounding courts, you may not have to go. There are exceptions, though, and there is one deadline you cannot afford to miss.

When Your Lawyer Can Appear for You

Tickets written in the City of Albany are handled in Albany City Court. Tickets from the surrounding towns and villages, such as Colonie, Guilderland, and Bethlehem, go to that town or village court. Albany is not a Traffic Violations Bureau jurisdiction, so these tickets are handled by local courts where plea negotiation is available.

For many traffic infractions, such as speeding, failing to stop, or using a phone while driving, the court may allow your attorney to appear on your behalf. When it does, you avoid a lost workday and the need to arrange travel if you live outside the area.

When You May Still Need to Be There

  • The judge requires it. A judge can order you to appear in person, for example for a trial or to accept a particular plea.
  • The charge is a misdemeanor. Charges such as aggravated unlicensed operation (VTL § 511) or driving while intoxicated (VTL § 1192) are criminal matters and generally require you to appear.
  • You will testify. If your case goes to trial and your own account of what happened matters, you will need to be there.

Your lawyer will tell you early whether your court is likely to require you, so there are no surprises.

Do Not Miss the Response Deadline

Hiring a lawyer does not pause the ticket. You must answer it by the date printed on it. If you fail to answer or fail to appear, the court can have your license suspended (VTL § 510(4-a)), and lifting that suspension takes time and money. Contact a lawyer as soon as you get the ticket so a plea can be entered on time.

What Happens After You Hire a Lawyer

  1. Your attorney enters a not-guilty plea for you, often by mail or at the first court date.
  2. Your attorney can request a supporting deposition, which is the officer’s sworn account of the facts. If it is requested on time and not provided, the ticket can be dismissed (CPL § 100.25).
  3. Your attorney reviews the evidence and talks with the prosecutor, often seeking a reduction to a lower-point or non-point violation.
  4. You approve any plea before it is entered. If there is no acceptable offer, the case can be set down for trial.
