Real Estate FAQ

How Much Does a Real Estate Attorney Cost in Albany, NY?

Most Albany-area real estate attorneys charge a flat fee for a standard residential purchase or sale. Seraj Law's flat fee is $1,000 to $1,500, depending on the transaction, and we quote your fee before you sign. The legal fee is separate from other closing costs, such as title insurance, recording fees, transfer taxes, and lender charges.

The legal fee is one of the smaller line items in a home purchase or sale, but it is fair to ask about it up front. Here is how pricing usually works in the Capital Region, what moves the number, and how to compare quotes on equal terms.

Flat Fees Are the Norm for Residential Closings

Most attorneys handle standard residential purchases and sales for a flat fee rather than by the hour. Seraj Law’s flat fee for a standard residential purchase or sale is $1,000 to $1,500, depending on the transaction. We quote your fee before you sign, so you know your legal cost from the start.

Commercial transactions are more often billed hourly or under a custom fee arrangement, because the work varies so much from deal to deal.

What Affects the Fee

  • Whether you are buying or selling, and whether there is a mortgage
  • A single-family home versus a multifamily property, condominium, or new construction
  • Title problems, such as old liens, an open estate, or boundary issues
  • Renegotiation after the home inspection
  • Sales involving an estate, a divorce, or a short sale
  • A tight or shifting closing timeline

Your attorney’s fee is only one part of what you pay at closing. Other costs commonly include:

  • Title insurance premiums for the owner’s and lender’s policies, plus title search charges
  • County recording fees for the deed and mortgage
  • New York transfer taxes, customarily paid by the seller, and on higher-priced homes the mansion tax, paid by the buyer
  • Lender charges, such as origination, appraisal, and credit report fees
  • Escrow deposits and prepaid property taxes and homeowner’s insurance
  • Survey costs

If you are financing, your lender’s Loan Estimate and Closing Disclosure list these costs in detail, and your lawyer can walk you through them.

What a Low Quote May Leave Out

A low headline fee is not always the lowest total cost. Ask whether the quote includes:

  • Contract review and negotiation, or only the closing itself
  • Title review and clearing any problems that come up
  • Attending the closing
  • Preparing the deed and transfer forms, for sellers
  • Separate charges for document preparation, courier, or wire fees

Comparing what each quote covers, not just the number at the top, is the only fair way to shop.

Get the Fee in Writing

New York court rules require a written engagement letter or agreement for most legal matters (22 NYCRR Part 1215). Yours should state what the fee covers and what would cost extra, such as a closing that is delayed for months or a title problem that takes significant work to resolve.
